Dokument ten stanowi regulamin zgodnie z którym świadczone są usługi cyfrowe w aplikacji webowej Rentmatic w domenie rentmatic.pl. Każda osoba korzystająca z serwisu Rentmatic, niezależnie od zakresu korzystania, przyjmuje do wiadomości i akceptuje niniejsze zasady.

  7. Zmiany w niniejszych Warunkach Korzystania będą ogłaszane Użytkownikom Zarejestrowanym poprzez e-mail.
  8. Polityka Prywatności i Polityka Cookies stanowią integralną część niniejszych Warunków Korzystania.

Definicje

  1. Operator - oznacza twórcę serwisu Rentmatic utrzymywanego w domenie rentmatic.pl.
  2. Rentmatic - aplikacja (serwis) internetowy dostępny pod adresem URL https://rentmatic.pl/
  3. Użytkownik - każda osoba fizyczna, prawna lub jednostka organizacyjna nieposiadająca osobowości prawnej wykorzystująca serwis Rentmatic w dowolnym zakresie.
  4. Użytkownik Zarejestrowany - każda osoba fizyczna, prawna lub jednostka organizacyjna nieposiadająca osobowości prawnej posiadająca aktywne konto zarejestrowane w serwisie Rentmatic.
  5. Konto - zbiór danych zapisanych w bazie danych Rentmatic w celu jednoznacznej identyfikacji Użytkownika Zarejestrowanego oraz w celu gromadzenia i procesowania danych dotyczących jego nieruchomości, najemców, szablonów umów, umów, rozliczeń oraz ustawień.
  6. RODO - oznacza Rozporządzenie UE o ochronie danych osobowych oraz wszelkie inne przepisy unijne oraz krajowe z nim powiązane.
  7. Kod Źródłowy - oznacza zbiór plików tekstowych oraz binarnych w którym zapisany jest kod strony (backend) serwisu Rentmatic, kod interfejsu użytkownika wraz z formatowaniem (frontend), struktury baz danych, elementy graficzne i typograficzne identyfikujące serwis Rentmatic. Kod Źródłowy nie obejmuje kodu bibliotek opensource JS, CSS i PHP dostarczonych przez podmioty trzecie. Lista tych bibliotek wraz ze stosownymi licencjami ich twórców dostępna jest na stronie rentmatic.pl/main/licenses.

Postanowienia ogólne

  1. Operator provides Rentmatic for free-of-charge use in the Enabled Locations under the terms and conditions stipulated in this document and appendices attached therein.
  2. In order to use Rentmatic, one needs a computer (PC or Mac), a tablet (with OS Android/iOS/Linux) or a smartphone (with OS Android/iOS) with access to Internet, a web browser supporting modern JavaScript and HTML 5+.
  3. Operator does not maintain Rentmatic for profit.
  4. Operator applies the data protection practices and codes as stipulated in GDPR (for the EU/EEA) and EDPR (for countries outside of the EU/EEA). The Privacy Policy, which is an integral part of this document, can be found at: recruyo.com/privacy. The Privacy Policy provides the detailed description of how Operator uses user data to provide Services and what rights Users have pertaining to protection of their data.
  5. Operator uses cookie files in order to properly supply Services to Users. The use of cookies is limited to routine session recognition and maintenance and routine analysis of traffic on the site (the latter provided by an external service provider). The full description of how Operator uses cookies can be found in the Cookie Policy, which is an integral part of this document, and can be found at: recruyo.com/cookies.
  6. Operator prohibits any use of the Rentmatic Source Code, except for the use allowed under the terms and conditions stipulated in this document, without a prior written consent.
  7. Operator accepts discretionary donations made in either Bitcoin (BTC) or Ethereum (ETH) or other ERC-20 compatible tokens to support the maintenance and further development of Rentmatic. Donations are non-refundable.
  8. Operator requires that all Users use English language at Rentmatic. Both American and British English are acceptable.

Account

  1. Registering, maintaining and using an Account at Rentmatic is free of charge.
  2. Candidate may register an Account at Rentmatic.
  3. Candidate without an Account can freely look up job offers and apply for them without an Account. However, having an Account can significantly speed up the applying process and make it easier to keep track of past applications submitted.
  4. Recruiter must register an Account at Rentmatic in order to use Rentmatic to post job offers and get access to candidates' applications. Recruiter may use Rentmatic without an Account as a Candidate.
  5. Candidate registering an Account at Rentmatic needs to fill in the form at: recruyo.com/signup, providing a valid email address, a password of acceptable strength (as determined by the validator active in the registration form) and accepting Terms and Conditions of Rentmatic.
  6. Recruiter registering an Account at Rentmatic needs to fill in the form at: recruyo.com/signup, providing a valid email address, a password of acceptable strength (as determined by the validator active in the registration form), a website URL of the company the recruiter works for, and accepting Terms and Conditions of Rentmatic.
  7. Submission of the registration form at recruyo.com/signup means expressing an unretractable consent to the Terms and Conditions.
  8. Account of Candidate and Account of Recruiter require activation prior to be operational. Activation is performed by clicking the activation link in the welcome email sent automatically right after submitting the registration form.
  9. Inactive accounts are automatically deleted from Rentmatic databases within 48 hours.
  10. After activating an Account, Recruiter must complete the company info section in the /settings tab in order to enable starting new recruitment processes and posting job offers. Company information required is: the name of the company, the website of the company (pre-populated based on the input from the registration form) and a logo in PNG or JPG uploaded as prompted by the site's tool.
  11. Operator prohibits use of Accounts in a manner not consistent with their intended purpose. In particular, it is forbidden to upload any content that violates any local, state or international rules and regulations or that exposes Operator to risk of severe damage or loss of data or data consistency or cause any other harm, damage or adverse reputational impact.
  12. Registered User can reset a forgotten password to Account by following the procedure at recruyo.com/password.
  13. It is a sole responsibility of Registered Users to keep their password safe and not to disclose them to any third parties at the risk of data loss, manipulation, Account deletion and other negative consequences that will not be rectified by Operator.
  14. Operator reserves a right to block, suspend or delete any Account without prior notice.
  15. Registered Users can delete their Accounts at any time using the designated section in the SETTINGS tab.
  16. Operator is not responsible for any loss of data due to inconsiderate deletion of Accounts.
  17. Operator may reach out to Recruiter to verify the registration data and is entitled to ask for any documents to confirm Recruiter's empowerment to represent the company indicated in the registration form and/or qualifications to act as a professional recruiter. In case of Recruiter's failure to furnish adequate evidence of empowerment, Operator may suspend or delete the Account.

Posting Recruitments

  1. Posting Recruitments (with associated job offers) requires an active Account at Rentmatic registered by Recruiter.
  2. In order to post a job offer at Rentmatic, Recruiter needs to log in, click RECRUITMENTS, then "NEW RECRUITMENT" and fill in the form in a manner consistent with the instructions and requirements checked by the validators. A draft of uncompleted recruitment can be saved to be worked on later.
  3. After publishing a recruitment, the job offer described therein becomes visible in the results of Search Engine.
  4. Recruitments can be ended manually by Recruiters or automatically by Rentmatic when their allotted time is up.
  5. Ending Recruitment means that the job posting is no longer visible in the Search Engine. If Recruiter opted for allowing Candidates applying directly via Rentmatic, ending a Recruitment means Candidates will no longer be allowed to do so.
  6. Ended Recruitments cannot be re-opened.
  7. Ended Recruitments allow access to any Applications submitted, until Recruitment is permanently deleted either by Recruiter or automatically by Rentmatic.
  8. If Recruiter does not delete an ended Recruitment, it will be automatically deleted, along with all Applications, within 10 days after ending the Recruitment.
  9. Recruiters acknowledge, that Candidates are allowed to withdraw their Applications at any time. When they do so, their Applications automatically disappear from Recruiters' dashboard. Recruiters may receive an email notification whenever a Candidate withdraws an application, provided that Recruiter has the respective Account setting turned on in the SETTINGS tab.
  10. Operator prohibits posting job offers that are fake, misleading or against rules of local or international laws and regulations.
  11. Operator reserves a right to suspend, cancel or delete any recruitment if there is any reasonable doubt about validity, legality or accuracy of the associated job offer.

Submitting Applications

  1. Candidate can apply for any active job offer available in Search Engine of Rentmatic.
  2. Candidate can apply only once for any given job offer.
  3. Candidate can apply with our without an Account.
  4. To apply without an Account, Candidate needs to click "Apply" next to the relevant job offer in search results and complete the application form as required. A CV file in PDF format may be required.
  5. To apply with a Rentmatic account, Candidate will also need to complete an application form. However, it will be pre-populated with all data provided by the Candidate in SETTINGS tab, including any pre-uploaded CV.
  6. Candidates may withdraw submitted Applications at any time, before they are deleted due to deletion of the associated Recruitment.
  7. By completing the form Candidates give their consent to processing data contained therein for the purposes of the recruitment.
  8. Operator prohibits providing misleading, false or inaccurate data in Applications.
  9. Uploading CV documents containing any hazardous code (malware, bots, viruses, worms, etc.). is strictly prohibited and may result in a legal action against the perpetrator.

Responsibilities of Operator

  1. Operator is responsible for acting in good faith and exercising reasonable effort to maintain, debug and develop Rentmatic for the benefit of Users.
  2. Operator is responsible for processing personal user data in a manner consistent with this document, including Privacy Policy, and with the rules of GDPR and all applicable EDPRs as may be applicable depending on the location of Recruiters and Candidates.
  3. Operator is not allowed to use data gathered within Rentmatic for monetization in form of subscription charges, service charges or any similar forms of remuneration for supply of electronic services.
  4. Operator is responsible for enabling the use of Rentmatic for a wide range of Users, taking into consideration a wide range of diversity and inclusion factors. Operator does not tolerate any form of discrimination, hate speech, misogyny or other traits that contradict the mission statement and the pivotal values of Rentmatic.

Responsibilities of Users

  1. Users are required not to use Rentmatic in a manner divergent from the original intent set forth by Operator.
  2. Users must not use Rentmatic to commit any deeds that perpetrate local, state or international laws or regulations.
  3. Users are expected to act in good faith and responsibly.

Disclaimers

  1. OPERATOR IS NOT LIABLE FOR ANY DAMAGE, LOSS, NEGATIVE IMPACT, CURTAILMENT, MISSED OPPORTUNITY OR ANY OTHER ADVERSE CONSEQUENCE THAT RESULTED FROM OR MAY HAVE INDIRECTLY RESULTED FROM USING RECRUYO, REGARDLESS OF SCOPE, INTENT AND INTENSITY.
  2. BY USING RECRUYO EACH AND EVERY USER INDEMNIFIES OPERATOR AGAINST ALL POTENTIAL DAMAGES THAT MAY HAVE RESULTED FROM THE USE OF RECRUYO IN A MANNER CONTRADICTORY TO THE TERMS AND CONDITIONS STIPULATED HEREIN.
  3. OPERATOR GRANTS NO WARRANTY WITH RESPECT TO ANY FUNCTIONALITY OF RECRUYO. EACH AND EVERY USER ACKNOWLEDGES, THAT THEY USE RECRUYO AT THEIR OWN RISK.
  4. OPERATOR WILL NOT BE HELD LIABLE FOR ANY DAMAGE, LOSS, NEGATIVE IMPACT, CURTAILMENT, MISSED OPPORTUNITY OR ANY OTHER ADVERSE CONSEQUENCE OF TEMPORARY OF PERMANENT DISCONTINUATION OF OPERATION OF RECRUYO.
  5. OPERATOR RESERVES THE RIGHT TO CANCEL RECRUYO AT ANY TIME WITHOUT PRIOR NOTICE AND WITHOUT GIVING ANY BUSINESS OR LEGAL JUSTIFICATION.
  6. OPERATOR MAY SELL RECRUYO TO A THIRD-PARTY ALONG WITH ALL DATABASE RECORDS, INCLUDING USER ACCOUNTS, RECRUITMENTS AND APPLICATIONS. SHOULD SUCH A TRANSACTION BE CONSIDERED LIKELY TO TAKE PLACE, ALL REGISTERED WILL BE INFORMED ABOUT THIS EVENT WITH A REASONABLY EXPECTED PRIOR NOTICE.

Miscellaneous

  1. Privacy Policy and Cookie Policy are integral part of Terms and Conditions.
  2. Any revisions to this document will be communicated to all Registered Users with emphasis on the most significant changes.
